Ticketing terms and conditions
Definitions
- In these terms and conditions:
- References to ‘We’ or ‘Our’ means the State Library;
- References to ‘You’ apply to the original purchaser of the tickets and any subsequent ticketholder;
- the following definitions apply:
Agent means Eventbrite, Inc;
Claim includes any claim, action, proceeding, demand, liability, obligation, costs, loss, damages and expenses, including legal expenses;
Conditions of Entry means the State Library Conditions of Entry available on our website;
Force Majeure Event means:- acts of God;
- pandemic or epidemic;
- war, riot, insurrection, vandalism or sabotage;
- terrorism, act of war, invasion, act of public enemies, civil war, rebellion, revolution, insurrection, military or usurped power hostilities, whether war is declared or not;
- fire or flood, except to the extent caused or contributed to by the effected party or its subcontractors;
- strike, lockout, ban or other industrial disturbance which was not caused or contributed to by the effected party or its subcontractors;
- government restrictions, to the extent that it is an unforeseeable event beyond the control of the State Library which occurs without fault or negligence of the State Library;
Staff means State Library staff and includes contractors engaged by State Library, including security guards and event suppliers;
State Library means the State Library of Queensland;
Venue means the venue at the State Library where the event takes place, including the South Bank building and The Edge.
Ticketing terms and conditions
- Tickets are sold by our Agent for and on behalf of State Library and are subject to the following Terms and Conditions.
- By purchasing a ticket from the Agent, you acknowledge and agree that you have read and understood these Terms and Conditions and agree to be bound by these Terms and Conditions. If you are purchasing a ticket on behalf of someone else, you agree to inform them of these Terms and Conditions.
- Tickets are only valid for the specific event (including date and time) specified on the ticket.
Variation to Terms and Conditions
- State Library reserves the right to vary these Terms and Conditions at any time by updating them. Any variations to these Terms and Conditions will only apply to ticket purchases made on and from the date that these Terms and Conditions have been updated.
Variations to performances or events
- State Library reserves the right to add, withdraw, reschedule or substitute artists/speakers and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity.
Conditions of entry
- Our Conditions of Entry support the enjoyment and safety of visitors and staff. State Library includes our South Bank building and The Edge. In purchasing a ticket from the Agent, you acknowledge and agree that you have read, understood and agree to be bound by our Conditions of Entry. A full list of the Conditions of Entry is available on the State Library website.
- Some ticketed events may be subject to specific entry requirements, including age restrictions. These additional entry requirements will be advised to you at the time of ticket purchase or event registration.
Refunds and Exchanges
- Tickets will not be refunded or returned after purchase except as required by these Terms and Conditions, by law, and/or as provided in the Live Performance Australia Ticketing Code.
- If the event is cancelled, rescheduled, significantly relocated or is materially different to how it was advertised, you will be entitled to a full refund or transfer to a rescheduled date (if applicable).
- When refunds are permitted, or in the event of the cancellation of a performance, monies will only be refunded to the original ticket purchaser via the original payment method that was used to purchase the ticket/s.
- Ticket exchanges will not be available except as allowed for at 12. above or for specific events where this is advised at time of purchase.
- You will not be entitled to a refund if:
- the event is delayed or interrupted due to technical difficulties that are corrected in a reasonable time;
- you are unable to attend the event due to illness, travel, parking, late arrival, a change in your personal circumstances or other personal reasons;
- you leave during the event due to illness, or because you did not enjoy the event, or the event was not what you expected;
- if your tickets have been resold/purchased through an unauthorised agent;
- tickets for the event become cheaper due to discounts or promotions;
- tickets were purchased using a stolen credit card or by another fraudulent way;
- you are denied entry or asked to leave the Venue because you fail to comply with the Venue Conditions of Entry;
- you are denied entry to the Venue because you cannot produce your ticket, or you cannot provide satisfactory evidence of an entitlement to a concession;
- State Library is not liable for any failure to perform due to Force Majeure Events beyond its control.
- You acknowledge and agree that you should carefully consider the refund and cancellation policies of travel, accommodation and any other providers when deciding to and making arrangements to attend an event. You may wish to consider acquiring a relevant insurance policy to cover you for any losses in the event of rescheduled events, relocations and or cancellations.
- You acknowledge and agree that:
- lock-outs may apply for some shows. Admission may be refused after the lock-out period commences;
- latecomers may only be admitted at the discretion of the State Library if there is a convenient break in the performance; and
- Tickets are not refundable if admission is refused due to arrival after the lock-out period.
Additional event conditions
- The use of audio and video recording devices of any kind is not permitted in the Venue unless otherwise indicated.
- You are responsible for having a printed or digital copy of your ticket/s. A valid ticket or registration confirmation must be presented for entry.
- You may be refused entry or required to leave the Venue if you do not comply with staff instructions. Tickets will not be refunded in these circumstances unless required by law (including the Australian Consumer Law).
- Attendees who disrupt an event, or who are in use or possession of a device prohibited by our Conditions of Entry, may be asked to leave the venue.
Pricing and on-selling of tickets
- Tickets are only valid if purchased through State Library’s authorised Agent.
- Tickets that are obtained by fraudulent means will not be valid and can be cancelled by State Library at any time, without refund.
- Tickets must not be resold or offered for resale at a price higher than the price printed on the ticket. If a ticket is sold or used in contravention of this condition, the ticket may be seized or cancelled without refund and the bearer of the ticket may be denied admission.
- Where tickets are lost, stolen, misplaced or destroyed, State Library may require proof of identity and purchase, prior to issuing a replacement ticket or at time of entry.
Seat reservations and accessibility
- When tickets are sold as General Admission, seating will be available on a first arrival basis.
- Reserved seats can be made available to attendees requiring specific seating for wheelchair and mobility support and can be reserved by contacting the event organiser in advance.
- The State Library is committed to providing accessible events. If you have any specific accessibility requirements, please contact us before the event or booking a ticket.
Privacy
- By purchasing a ticket, you acknowledge and agree that your personal information will be collected, used and disclosed in accordance with our Privacy Policy and the Privacy Policy of our authorised ticketing agent.
- We engage a third party ticketing provider to process all ticket sales. To facilitate your booking, the ticketing agent will collect personal information such as your name, contact details, and payment information on our behalf. The ticketing agent may also collect additional information required to deliver ticketing services, manage your booking, provide customer support, or meet regulatory obligations. - We receive from the ticketing agent only the personal information necessary for us to manage the event, ensure venue safety, administer your attendance, and communicate with you regarding the event. We do not receive or store your payment card details.
Liability
To the full extent permitted by the law (including the Australian Consumer Law), you release, discharge and indemnify the State Library from and against any Claim that may be brought against or made upon or incurred by the State Library arising from or in connection with:
- the carrying out of your obligations under any associated terms and conditions, including these Terms and Conditions, the Agent’s terms and conditions and the Conditions of Entry;
- your attendance at an event or attendance at the State Library;
- any willful, negligent or unlawful act or omission by you;
- a breach of any associated terms and conditions, including these Terms and Conditions, the Agent’s terms and conditions and the Conditions of Entry,
except to the extent that such a Claim arises as a result of a negligent or willful act or omission by the State Library.
- Where liability cannot be excluded by law, the maximum liability that the State Library will have to you under any circumstances is the face value of the ticket purchased.
- You attend the event and the Venue entirely at your own risk.
General
- These Terms and Conditions are subject to any applicable laws, including the Australian Consumer Law,
- If any part of these Terms and Conditions are held to be invalid, illegal or unenforceable, it will be disregarded to the extent of its invalidity and the remainder of these Terms and Conditions will remain in full force and effect.
- These Terms and Conditions are governed by the laws of Queensland, Australia.
